License clarification request: is the devkit source code OK for commercial use?

Hi, thanks for maintaining nuscenes-devkit.
The PyPI page says the license is "Free for non-commercial use (apache-2.0)", while the LICENSE.txt in this GitHub repo says only Apache-2.0. These seem to point in different directions.
Our situation: we want to use only the devkit source code in a commercial product. We will NOT use the nuScenes dataset.
In this case, is the source code usable for commercial purposes under Apache-2.0, or do we need to obtain a commercial license?
